e. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the intellectual property owner or authorized to act on the owner's behalf.
Action Upon Receiving a Notice of Infringement
Upon receiving a notice of infringement, Land Guard Garden will take appropriate action, which may include removing or disabling access to the allegedly infringing content or product. We may also, in our sole discretion, terminate the accounts of users who are found to be repeat infringers.
Counter-Notice
If you believe that your content or product has been removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our Intellectual Property Rights Officer. The counter-notice must include:
a. Your name, address, telephone number, and email address.
b. A description of the material that has been removed or disabled and the location where it appeared before its removal or disabling.
c. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
d. Your consent to the jurisdiction of the federal court in US and a statement that you will accept service of process from the person who provided the initial notice of infringement.
Please note that the submission of a counter-notice may lead to legal proceedings between you and the complaining party to determine ownership or right to use. We may restore the content or product in question if we receive notice from the complaining party that they have withdrawn their claim or if we receive a court order resolving the matter in your favor.
